Infrastructure and Construction

Our Infrastructure and Construction practice has built a solid reputation over the years under the helm of our Senior Counsel. Like our other practice groups, our approach in Infrastructure and Construction is a commercial one, orientated toward accurate identification of commercial problems, and a keen understanding of clients’ commercial needs. We spend time with clients on site in order to appreciate the issues on an actual business and operational level, wherever in the world they may be, and this shows in the clarity and specificity of our work output. Where required, we will collaborate with our network of experienced consultants and experts within the relevant industry to achieve the optimal outcome for clients.

Our clients include international and domestic developers, construction companies and management corporations in strata developments. We advise them in both contentious (in mediation, arbitration and litigation) and non-contentious matters (advising in their transactional documentation). For example, for transactional project finance requirements, we draw on our wide network of contacts of law firms in other jurisdictions where projects are popularly situated to provide sophisticated and commercially-savvy services. We retain a hands-on lead coordination role, if clients request and if it is cost-effective for them if we are to take on this role.

Examples of construction matters handled include:

  • Court proceedings, arbitration, Strata Title Board proceedings and mediation
  • Adjudication under the Building Construction Industry Security of Payment Act
  • Defects, damage, water seepage, encroachment
  • Extension of Time, Liquidated Damages, Prolongation and Variations
  • Defending clients against criminal charges brought by government agencies
  • Wrongful termination Advice on SIA, PSSCOC, REDAS contracts

Energy

Our energy practice group works with an array of renewable energy and conventional energy spectrum in attaining their dispute resolution objectives.

On the renewable energy front, our focus is on project finance and other project-related disputes. As we have experience acting for private equity clients on high value matters generally, we understand project financing disputes holistically. These translate into particularly focused and powerful advocacy for our clients.

On the conventional energy front, predominantly oil, we act for upstream and downstream clients. We thus have extensive experience in disputes involving exploration, FPSO services, commodities trading, trade finance, credit and security, shipping law, and insolvency. We have recent experience acting both for and against major global commodities trading houses in a range of their frequently occurring disputes.
